1.

 What is typically covered by personal umbrella insurance?
 Personal Umbrella insurance normally provides additional protection for the third party (damage to others) risks covered by your auto, watercraft, and homeowners policies. In addition, it is typically broader than your auto, watercraft and homeowners policies and will likely cover some combination of the following (sometimes over a small deductible):
  • Personal liability (including some combination of slander, libel, defamation of character, invasion of privacy, wrongful entry or eviction, and other similar exposures).
  • Not-for-profit directors and officers coverage.
  • In some states, certain first party coverages, like uninsured and underinsured motorists coverage.
Please note that excess personal umbrella insurance is not commercial insurance and will not cover your professional liability or the liability of a business.

 Why do people buy excess personal umbrella insurance?
 If any of the following apply to you, you should consider excess personal umbrella insurance:
  • Your assets exceed your existing personal umbrella coverage.
  • You need to protect your future earnings from a personal liability lawsuit.
  • You have a higher than average exposure to a personal liability lawsuit. For example:
    • You are financially responsible for the actions of an inexperienced or elderly driver.
    • You donate time to the board of a not-for-profit organization.
    • Your address makes you a target for a lawsuit.
    • Your income makes you a target for a lawsuit.
    • Guests are frequently on your property.
(Note: If an exposure is excluded under your current personal umbrella policy, it will be excluded under our excess personal umbrella policy as well. Additional exclusions may apply in our excess personal umbrella policy).

 How will my excess personal umbrella policy differ from my underlying personal umbrella policy?
 Our excess personal umbrella policy may be narrower than your underlying personal umbrella policy in some important ways:
  • The limit of our excess personal umbrella policy is an aggregate limit. Under our excess personal umbrella policy, you will be covered in a first occurrence up to the aggregate limit. If you exhaust your aggregate limit in the first occurrence, there will be no coverage for additional occurences during that policy period. However, if you do not need the full aggregate limit in a first occurrence, you will continue to be covered in additional occurences until you have exhaused your aggregate limit.
    In contract, your underlying personal umbrella policy may not have an aggregate limit. Although your coverage is limited to the per occurrence limit for any given occurrence, you theoretically may have coverage for an unlimited number of occurences.
  • Similarly, to keep prices as low as possible, our excess personal umbrella insurance requires that any dispute you have with us be settled by arbitration and not by a lawsuit.
  • Under some circumstances, courts have found an occurrence can be continuous in nature and can span multiple policy periods. In such a circumstance, our excess personal umbrella insurance will respond only if the occurrence commences during the policy period.
  • The coverage terms sometimes differ between states, please refer to the policy.
  • Our excess personal umbrella policy will not provide coverage for business activities or professional services conducted by any insured.
  • We will not provide coverage for the rental of any property you own.
There may be other differences between your underlying personal umbrella insurance and this excess personal umbrella insurance. Please read the Sample Policy carefully to be sure you understand any differences.
 

4.

 What concerns should I have about buying excess personal umbrella insurance?
 Excess personal umbrella insurance can provide important protection, however, it does have some limitations that your underlying policy may or may not have. In particular:
  • Excess personal umbrella insurance is not broader than your underlying personal umbrella policy, and in some cases may be narrower. It provides coverage for any claim covered by your underlying personal umbrella policy. However, it has limitations that your underlying personal umbrella policy may not have (please see Question 3 above).
  • Any claim denied by your underlying personal umbrella insurer will not be covered by this excess personal umbrella insurance.
  • If your underlying personal umbrella insurer becomes insolvent and is unable to pay your claim, your excess personal umbrella insurance will not drop down to pay the underlying insurer’s obligation. In such an event, you will retain the responsibility for the underlying insurer’s portion of the loss.
  • Excess personal umbrella insurance is not a substitute for commercial insurance and will not provide coverage for your professional liability of a business you own.

 Will a Berkshire Hathaway Group insurer provide coverage over my specific underlying personal umbrella insurer?
 In most cases, your existing personal umbrella insurer must be rated A- or better by A.M. Best Company. If you are unsure of your existing personal umbrella insurer's rating, you may find that information on-line at http://www.ambest.com. where you can do a "Rating Search" free of charge.

If your existing personal umbrella insurer is not rated at least A-, we may still be able to provide you excess personal umbrella coverage. If you would like us to consider an underlying insurer with a lower rating, please email us at info@brkdirect.com or call us at (800) 786-6426 and ask for the Excess Personal Umbrella Department.
 

6.

 How do I apply for an excess personal umbrella policy?
 The application process for the excess personal umbrella policy is very simple. To apply, first use our online EZquote. From there, fill out the on-line application, print it, and sign it. (The application will automatically set the effective date to 10 days after the date the application is filled out and will calculate your pro-rated premium). Mail the application along with a premium check and a complete photocopy of your underlying personal umbrella policy (including the declarations page, the rate sheet, any other documents showing the premium amount, effective date, expiration date, policy limit and complete application form) to the address on the application. Upon receipt of these materials, we will issue you a policy or return all materials to you (including your uncashed check) if we are unable to provide coverage. If these materials are not received by us within 10 days of the date the application is filled out, we will move the effective date to the date the application is received and adjust the premium accordingly.

If we feel that your application is incomplete or we require additional information, we may call you at the phone number you provide on the application.
 

7.

 How can I match the coverage periods of my excess and underlying personal umbrella policies?
 Your excess personal umbrella policy will be issued with the same expiration date as your underlying personal umbrella policy. The premium for your excess personal umbrella policy will be equal to 90% of the premium for your underlying personal umbrella policy, subject to a minimum annual premium of $100 per $1,000,000 of coverage, pro-rated to the time your excess personal umbrella policy will be in effect (total premium on underlying personal umbrella policy multiplied by number of days from inception to expiration of excess personal umbrella policy divided by number of days from inception to expiration of underlying personal umbrella policy).

This way, when you renew your underlying personal umbrella policy next year, your excess personal umbrella policy will have the same inception and expiration dates as your underlying personal umbrella policy.

The shortest period for which Berkshire Hathaway Group can issue an excess personal umbrella policy is 90 days. If your existing personal umbrella policy will expire within the next 90 days, our excess personal umbrella policy must incept at the inception date of your renewal policy.  How much coverage can a Berkshire Hathaway Group insurer provide me?
 This product is designed to double your existing coverage up to a maximum coverage of $10,000,000 above your existing coverage. Under certain circumstances, we may be able to provide more coverage than an amount equal to the limit on your existing personal umbrella policy. We may also be able to provide a limit greater than $10,000,000.  What happens if my risk characteristics change during the term of my excess personal umbrella policy?
 If the answer to any question on your application changes or if you are required by the terms of your underlying personal umbrella insurance to notify your underlying personal umbrella insurer of a change, you must notify us. In the event that any change alters the premium for your underlying personal umbrella policy, the premium for your excess personal umbrella policy will be revised as well. Any reduction in coverage under your underlying personal umbrella policy will automatically reduce coverage under your excess personal umbrella policy as well. In some circumstances, we may be unable to continue to provide you coverage. In such a circumstance, your policy will be canceled and you will be returned pro-rata premium.
 

10.

 If I need to make a claim, what will be required of me?
 You should notify us as soon as possible after an occurrence for which you might need to make a claim. In any case, you should notify us no later than when you are obligated to notify your underlying personal umbrella insurer.

You must provide us with all available information. You must cooperate fully with us in any legal defense. In the event of a judgment, you must cooperate fully with us if we choose to appeal.

 Will my excess personal umbrella insurer defend me in a lawsuit?
 For coverage which is provided by your primary policies (automobile, watercraft, and homeowners policies), the duty to defend will normally reside with the primary insurer even if the size of the claim will exceed the limit of coverage for the primary insurance. Similarly, for coverage not provided by your primary policies which is provided by your underlying personal umbrella policy, the duty to defend will normally reside with your underlying personal umbrella insurer even if the size of the claim will exceed the limit of coverage for the underlying personal umbrella insurance. This arrangement is to your advantage because it encourages a consistent defense.

We will have the right but not the duty to associate in the defense of any suit which could result in loss under our policy.
 

12.

 Can I cancel my excess personal umbrella policy?
 Yes. If you cancel your excess personal umbrella policy, you will still be covered for any loss that commences between the inception date and the cancellation date. Your aggregate limit will be pro-rated to the amount of time the policy was in effect out of a period of one year (original aggregate limit multiplied by number of days from inception to cancellation divided by 365).

You will receive a return premium equal to the pro-rata portion of the premium that applies to the time the policy will no longer be in effect (total premium multiplied by number of days from cancellation to original expiration divided by number of days from inception to original expiration).
 

13.

 Are there industry recognized ratings of an insurer's financial strength I should consider before buying insurance?
 Major rating agencies, such as A.M. Best and Standard & Poor's, use their own rating criteria to grade an insurance company's financial strength and claims paying ability. The federal government does not guarantee insurance products. Therefore, you should carefully evaluate the financial ability of your insurer to be there when you make a claim. Depending on your state of residence, your excess personal umbrella insurance will be provided by either National Liability & Fire Insurance Company or National Indemnity Company. These companies are both ultimately owned by Berkshire Hathaway, Inc. and have been given the highest possible ratings by Standard & Poor’s (AAA, Extremely Strong Insurer Financial Strength Rating) and A.M. Best (A++, Superior).
